Terms of service

The terms we work under. Each project also has its own written scope, which takes precedence over anything general said here.

1. Who we are

2. Scope of work

Every project begins with a written scope setting out the pages, features, revision count and timeline. That document defines what is included. Anything not listed in it is additional work, quoted separately before it begins. We will not start work that has not been agreed in writing.

3. Payment

Unless the project scope says otherwise, fees are paid in three parts: 40% before work begins, 30% on approval of the design, and 30% before launch. Monthly retainers are billed at the start of each month. Prices quoted in USD are payable by bank transfer or Wise; Pakistani clients may pay in PKR by local transfer.

Advertising budgets are paid by you directly to Google or Meta and are not included in our management fee.

4. Your responsibilities

You agree to provide content, images and feedback within the timescales set out in the project scope, and to ensure that any material you supply does not infringe anyone else's rights. Delays in supplying content are the most common cause of a project running late, and will move the delivery date accordingly.

5. Ownership

On final payment, all deliverables produced for you become yours. Your domain, hosting, advertising accounts, analytics and Google Business Profile are registered in your name from the outset, with us added as a user. We do not hold client accounts as leverage, and if you end the engagement you take everything with you.

We retain the right to describe the work publicly and link to the live site, unless you ask us in writing not to.

6. Revisions and approval

Development does not begin until you have approved the design direction. Revisions at the design stage are included up to the number stated in the project scope. Changes requested after approval that alter agreed scope are quoted separately.

7. Search engine rankings

Search rankings are determined by search engines and are outside our control. We do not guarantee any particular position, traffic level or number of enquiries. We commit to a defined scope of work each month and to reporting honestly on results, including when results are poor.

8. Support and maintenance

Support periods after launch are stated in the project scope, usually 30 or 90 days, and cover faults in what we built. They do not cover new features, third-party service failures, or problems caused by changes made by others. Ongoing maintenance is available as a separate arrangement.

9. Liability

We are liable for losses caused by our own negligence or breach of contract, limited in aggregate to the fees paid by you for the project in question. We are not liable for indirect or consequential losses, including lost profits or lost data. Nothing here limits liability that cannot lawfully be limited.

10. Cancellation

You may cancel a project at any time in writing. Work completed up to that point is payable, and amounts already paid for work not yet started are refunded. Retainers require 30 days' written notice after the minimum term.

11. Confidentiality

Each party will keep the other's non-public information confidential. We will sign your own non-disclosure agreement on request.

12. Governing law

These terms are governed by the laws of Pakistan, and the courts of Lahore have jurisdiction. Where a separate written contract with a client specifies a different governing law, that contract takes precedence.
